When Can a Criminal Record Be Sealed or Expunged?
Florida law provides two different ways to limit public access to certain criminal records. Sealing generally restricts public access to an eligible record, while expungement goes further by directing agencies to destroy or otherwise remove the record from their files (Fla. Stat. § 943.059; § 943.0585).
You may be eligible for an expungement if prosecutors dropped your charges or a court dismissed your case prior to trial. If you pled guilty or no contest and received a withhold of adjudication, your record may be eligible for sealing instead.
Our attorneys can review your legal options and explain whether sealing or expungement may help put a past arrest behind you when applying for jobs, housing, and other opportunities.
Can You Be Convicted Based on Someone Else’s Word?
A witness’s testimony can be evidence in a criminal case, but the state still has to prove every element of the charged offense beyond a reasonable doubt. An accusation alone doesn’t become a conviction simply because someone tells police that something happened.
In some cases, witnesses can remember events differently, statements can change, and important context may be missing from an initial report. Other evidence may support or contradict claims, such as texts, recordings, photographs, medical records, or surveillance footage.
When your future depends on competing versions of events, you deserve a defense that takes the full story seriously. Our attorneys can help you understand the evidence against you, challenge inconsistencies in the prosecution’s case, and make sure your side of the story isn’t lost in the process.
