How Probate Works in Florida 

Probate is the court-supervised process of identifying a deceased person’s assets, paying off their outstanding debts, and distributing the remaining property to the rightful heirs. Do All Assets Have to Go Through Probate Court?

Non-probate assets can bypass the court system entirely and transfer directly to named individuals. This commonly includes assets held in a living trust, jointly owned property with a right of survivorship, and accounts with payable-on-death designations, such as life insurance policies or retirement funds.

Summary administration is a faster, streamlined alternative that doesn’t require a court-appointed personal representative. As of July 1, 2026, estates qualify for summary administration if the total value of non-exempt probate assets is $150,000 or less. Estates of any size can qualify if the deceased passed away more than two years ago. 

Qualifying for summary administration doesn’t necessarily mean it’s the best choice for your family. Estates with significant debt or brewing conflicts often benefit from the structure of formal administration. How Long Does Probate Take?

The timeline for settling an estate depends on the type of administration and the complexity of the assets.
