Misdemeanor Defense in Fort Walton Beach

Criminal Defense Informed by Both Sides of the Courtroom

Our prosecution experience shapes how we evaluate misdemeanor allegations, court procedures, and the choices available to a defendant. At Cotton & Gates, Attorneys at Law, our criminal defense representation draws on experience from both sides of the courtroom. We defend people facing first-time misdemeanor and felony charges while explaining what they can expect as their cases proceed.

An arrest or criminal accusation doesn’t determine the final outcome. We keep you informed of your options and engaged in your defense, from our initial review through the court proceedings that follow. We provide the personal service and zealous representation we would want in the same situation.

Charges That May Require a Misdemeanor Defense

Whether an allegation is charged as a misdemeanor or felony depends on the offense, the specific facts, and the applicable Florida statute. We defend clients against a range of criminal and traffic allegations without assuming that every charge in a broad category carries the same classification.

Our criminal defense work includes allegations involving:

Misdemeanor cases may also involve disorderly conduct or resisting an officer without violence. Even a charge considered less serious than a felony deserves a careful response because it can expose a defendant to jail, fines, court supervision, and a criminal record.

Florida Misdemeanor Classifications & Maximum Penalties

Florida divides misdemeanors into first-degree and second-degree offenses. An offense declared to be a misdemeanor without a specified degree generally defaults to a second-degree misdemeanor. Misdemeanors are punishable by no more than one year in a county correctional facility, but the maximum exposure depends on the degree of the charge.

The statutory maximum penalties are:

  • First-degree misdemeanor: Up to one year in county jail and a fine of up to $1,000.
  • Second-degree misdemeanor: Up to 60 days in county jail and a fine of up to $500.

These limits describe possible maximum penalties, not the sentence a particular person can expect. The charge, prior record, and resolution all affect what may happen. A felony is a different classification with potentially greater penalties and is generally handled at a different level of court.

Misdemeanor Court Proceedings in Okaloosa County

Okaloosa County handles misdemeanor cases separately from felony cases. Misdemeanor and criminal traffic matters generally proceed in county court unless a felony charge arises from the same incident. Our attorneys are familiar with Florida law and the state and local court systems that govern these proceedings.

Arraignment After an Arrest

An arraignment is the court appearance at which the charge is formally addressed and a plea may be entered. Under local procedures, misdemeanor arraignments must be set at least 15 calendar days after an arrest. South Okaloosa County misdemeanor arraignments take place at the Okaloosa County Courthouse Annex Extension in Fort Walton Beach.

An arraignment is one stage of the case, not a trial or an automatic determination of guilt. Defense counsel can assess the filed charge, explain the available options, and prepare the defendant to make informed decisions. We stay in communication so our clients understand what’s happening throughout the proceedings.

Access to Appointed Counsel

A Public Defender or another court-appointed attorney may be available to a defendant who can’t afford private counsel. Eligibility is determined through the applicable court process. Anyone considering private representation can use a consultation to discuss the allegation, anticipated proceedings, pricing, and payment options before deciding how to proceed.

Criminal Records, Sealing & Expungement

A misdemeanor record can create consequences outside the courtroom. Depending on the circumstances, it may affect employment, professional licensing, or immigration matters. These collateral consequences, meaning effects beyond the sentence imposed by the court, are one reason to consider the long-term implications of each decision in a criminal case.

Florida provides separate processes for record sealing and expungement. Sealing restricts public access to a criminal record. Expungement directs the destruction of criminal records as provided by law, although eligibility isn’t automatic for either form of relief.

Expungement eligibility may depend on the charge being dropped or dismissed. Sealing may be available when a person receives a withhold of adjudication, which means the court withholds a formal conviction after a plea. Eligibility depends on the case’s disposition, the person’s prior history, and other legal requirements, so a favorable disposition doesn’t guarantee that a record can be sealed or expunged.
