Florida Child Pornography Charges Under Section 827.071

Florida Statute 827.071 addresses several forms of conduct involving child pornography. It defines possession-related conduct as knowingly possessing or controlling material that includes sexual conduct by a minor under 18. It also prohibits knowingly soliciting or intentionally viewing that material.

Under subsection (5)(a), knowingly soliciting, possessing, controlling, or intentionally viewing material containing child pornography is a second-degree felony. Evidence of knowing conduct is central to these charges, while a viewing allegation turns on whether the conduct was intentional.

Subsection (4) separately prohibits possessing the material with intent to promote it. That allegation is a second-degree felony. Possession of three or more copies is prima facie evidence of intent to promote, meaning evidence legally sufficient to support that conclusion unless rebutted or explained by other evidence.

Knowledge, Control & Digital Evidence

Digital records don’t resolve every factual question. A device may be used by more than one person, internet access may be shared, and an account may be accessible through multiple devices. An accusation alone doesn’t establish who used a device, account, or network connection.

We examine the available evidence to determine what it shows about knowing possession, control, intentional viewing, or intent to promote.

That review may ask:

  • Who had access to the device, account, or shared network?
  • How and when were the files downloaded, stored, or accessed?
  • What evidence concerns knowledge, control, or intentional conduct?
  • What statements were made during interviews or other investigative contact?

We keep you informed about your legal options and engaged as the case develops. We don’t assume that a technical record resolves disputed questions without a careful factual review.

Consequences of Child Pornography Charges in Okaloosa County

The statute treats each prohibited image or other item as a separate criminal offense. Separate counts can substantially expand the scope of a case and affect potential sentencing exposure. The precise consequences depend on the filed charges, the evidence, any conviction, and the law that applies to the case.

A qualifying sex crime conviction can carry consequences beyond incarceration, including probation and restrictions concerning residence or employment. It can also require sex offender registration. Florida law distinguishes between sex offender and sexual predator designations, so the applicable classification and requirements must be evaluated under the circumstances of the conviction.

Felony cases arising in Okaloosa County are heard by the Okaloosa County Circuit Court as part of Florida’s First Judicial Circuit. The Okaloosa County Sheriff’s Office Judicial Services division performs criminal and sexual offender registration functions.
